Ifrah Law Managing Partner Jeff Ifrah was quoted in Dan Hajducky’s ESPN article examining whether sports card “box breaking” could be considered gambling or an unlawful lottery.
Hajducky explains how legal challenges against live shopping platforms are putting new scrutiny on a long-standing collectibles practice where buyers purchase slots in sealed card breaks without knowing what they will receive.
Jeff noted:
“I don’t think we’ve ever had someone at that level look and analyze this — they never get to the question of whether or not [collecting] is actually gambling activity.”
He added:
“If I’m buying to get a certain Sidney Crosby or David Pastrnak card, and repeating the behavior to do so … is that gambling or a bona fide purchase? This is the way cards have been sold.”
