Michelle Cohen is Quoted on FinTech’s Move to New Communication Techonologies in Debt Collection Process

In Bloomberg Law’s article, “FinTech Uses Machine Learning for Smarter Debt Collection,” Michelle Cohen is quoted on the rapidly changing communication technologies that are outpacing Telephone and Consumer Protection Act (TCPA) regulations, making debt collection communication efforts increasingly susceptible to class-action litigation. Michelle leads Ifrah Law’s Data Privacy & Cyber Security practice and has defended a number of individual and class actions in the consumer protection space. Regarding the TCPA’s definition of communication technologies, Michelle explains:
“If you go back to the legislative history, it was never intended for class actions. It was really intended for ‘Joe Q. Citizen’ who’s getting harassed at dinnertime to go to small claims court.”
